Terms of service

1. The service

Kromo lets you open a photo of a house or a room, select its surfaces and preview new paint colors and materials on them. Surfaces are found automatically and may be imperfect, and colors on screen are approximations: screens, light and finishes differ. Always check a real paint sample before you buy or paint.

2. Early access and accounts

Kromo is in early access and available by invitation. You must be at least 13 years old, and old enough to agree to these terms where you live. Keep your sign-in secure; you are responsible for activity on your account.

Early access is free. We may set limits, such as how many new photos you can open per day, and we may change or end early access at any time. If Kromo introduces paid plans, we will tell you before anything changes for your account.

3. Acceptable use

Do not use Kromo to:

• upload photos you do not have the right to use, or that show people in a way they have not agreed to;
• break the law, infringe anyone's rights, or upload anything harmful or abusive;
• scrape, copy or resell the service, or access it by automated means except as we allow;
• interfere with the service, get around its limits, or probe it for weaknesses.

You are responsible for the photos you upload and for decisions you make from a preview.

4. Your content

You keep all rights to your photos and to the images you download from Kromo. You give us a limited license to process your photos only to provide the service to you. We do not use your photos to train general-purpose AI models and we do not sell them.

5. Our property

Kromo, its software, design, sample images and content are owned by us or our licensors and protected by copyright and other laws. Apart from your own photos and the images you make from them, you may not copy, adapt or redistribute any of it. We reserve all rights, including the right to opt out of text and data mining.

6. Third-party services

Kromo relies on providers for hosting, computing, sign-in and email. Paint names and colors belong to their manufacturers and are shown for reference; Kromo is not affiliated with or endorsed by them.

7. Disclaimers

Kromo is provided as is and as available, without warranties of any kind, express or implied, including fitness for a particular purpose, accuracy of colors or surfaces, and non-infringement. Previews are illustrations, not professional advice.

8. Limitation of liability

To the fullest extent permitted by law, we are not liable for indirect, incidental, special, consequential or punitive damages, or for any loss of profits, data or goodwill, or for the cost of paint, materials or work chosen with the help of Kromo. Our total liability for any claim is limited to the greater of the amount you paid us in the twelve months before the claim or fifty US dollars.

9. Termination

You can stop using Kromo and ask us to delete your account at any time. We may suspend or end your access if you break these terms or to protect the service or others. Sections 4 to 11 survive termination.

10. Changes

We may update these terms. We will post the new version here with a new date, and tell you by email if a change is significant. Using Kromo after a change means you accept it.

11. Governing law and disputes

These terms are governed by the laws of the State of Florida, without regard to its conflict of law rules. Any dispute will be brought in the state or federal courts located in Palm Beach County, Florida. Nothing in these terms limits rights you have under the consumer protection laws of the place where you live.
